What is Evaluative Mediation?
Evaluative mediation is a structured, pragmatic form of mediation in which the mediator takes an active role in assessing the merits of each party’s case. Unlike facilitative mediation, which focuses purely on helping parties communicate, evaluative mediation involves expert feedback, commercial insight, and neutral opinion on likely outcomes.
This approach is especially suited to technical or contractual disputes, common in construction and property, where parties may benefit from a clear, informed view of legal, financial, or practical risks. The mediator acts not only as a neutral facilitator but also as a guide, helping parties understand where their positions are strong, where compromise may be necessary, and what a fair and viable settlement could look like.
Evaluative mediation still preserves party autonomy as the outcome is never imposed. However the process is grounded in reality, helping participants make commercially sensible decisions based on risk, evidence, and industry context.
